A company based in Japan that manufactures printer ink, Toyo Ink, has agreed to pay a $45 million settlement against false claims allegations related to tax and import duties. Among the allegations were those claiming that the company misrepresented its products’ country of origin in order to avoid import duties. The federal agency allegedly harmed in this lawsuit was the U.S. Customs and Border Patrol. According to allegations, the false claims had been submitted for 8 years from 2002 to 2010.
The whistleblower who brought the case under the False Claims Act is to receive $7.87 million out of the $45 million settlement. Whistleblowers in these and similar cases may be awarded up to 30% of the reward, depending on their participation in the fraud and/or the revealing thereof. Whistleblowers in IRS suits may also receive similar reward percentages.
