Female Victim Resided In Group Home
Multiple Incidents Of Sexual Assault And Rape Alleged
Protecting Vulnerable Loved Ones
People with intellectual disabilities experience more violence in general when compared to those without disabilities. In 2008, The National Crime Victim Survey found that people with disabilities experience higher rates of violence than people without disabilities (40 victimizations per 1,000 persons with disabilities compared to about 20 per 1,000 without disabilities), and that the rate of victimization is twice as high for people with disabilities. The same studies also consistently demonstrate that people with intellectual disabilities are sexually victimized more often than others who do not have a disability. Rape and other forms of sexual assault are crimes and also criminal acts of dependent adult elder abuse leading the suspect to further criminal charges and also supporting claims for civil liability against the actor and those who supervise him or her. Cal. Welf. & Inst. Code § 15610.63 (definition of physical dependent adult abuse includes any type of sexual assault). Evans Law Firm. Caregiver Arrested For Sexual Assault
In one recently reported case,[1] a caregiver in a group home has been arrested for sexual assault and rape of a dependent adult residing in the group home. According to an arrest warrant, police were called to a local hospital regarding an alleged sexual assault of a female. Upon arrival, they spoke with the victim, who was living in a group home for individuals with certain mental illnesses at the time of the assault and said she was sexually assaulted by her caregiver multiple times. One assault took place in the kitchen pantry; the victim then said she was raped twice in a separate bedroom. Police said the victim identified her attacker as a caregiver at her group home. The individual submitted to voluntary DNA sampling, according to the arrest warrant, which authorities were able to confirm matched DNA left on the victim. According to police, the suspect confessed to having sexual intercourse with the victim twice on the date in question.
Protecting Dependent Adults From Sexual Abuse
If you have any suspicions that a loved one in a group home or other facility is suffering any kind of abuse, alert the home’s administrator and the authorities. If your loved one is already a home resident, consider an in-room surveillance camera. Surveillance cameras in a facility room are permitted under California law.
