Detecting Elder Abuse
America’s baby boomers are now senior citizens, headed to that seventh stage of life that may bring “second childishness and mere oblivion” as Shakespeare wrote. The sad reality is that there are people ready to prey upon seniors entering that final stage of life. We have spent years at Evans Law Firm Inc. combatting the exploitation of seniors, subject to financial or physical elder abuse, and want to share some thoughts below on preventing abuse. Our financial elder abuse attorneys in particular have vast experience in investment and securities fraud cases, FINRA Arbitration, annuity and life insurance cases and financial elder abuse of every variety. If you or a loved one has been the victim of fraud or financial elder abuse call us today at (415)441-8669 and we can help.
We often write in this column that isolation presents the biggest danger for seniors. A dependent, isolated senior is particularly susceptible to manipulation and fraud. We have seen caregivers, insurance agents, advisors, and door-to-door con artists financially abuse lonely seniors, and offer you some tips on prevention. First and foremost, stay involved in your beloved senior’s life. Check in, keep an eye on their belongings and money, know who’s coming and going. If your loved one needs help you cannot provide, do background checks on anyone they hire and drop in as much as you can while the caregivers are on the scene. Monitor the senior’s bank accounts and credit cards and make sure their valuables are safely stored away. Be at any meeting or discussions about financial matters they may have with anyone else. Encourage old friends and other family members to check in too. You can’t do it all, but stay as involved as you can.
If you suspect abuse, act at once. We encourage you to report any elder abuse to the authorities. But also be sure to pursue all the remedies afforded by law. California leads the nation in protection for seniors and provides expedited trials, extra damages, and attorneys’ fees and costs in elder abuse cases. While law enforcement may get you restitution for your or your loved one’s injury it is not the responsibility of such agencies to pursue all the relief to which you and your loved one may be entitled. At Evans Law Firm our elder abuse attorneys can help; we know what the California elder abuse laws provide and we know how to represent you in pursuing your claims.
