Elder Evictions in San Francisco

Evictions of the elderly here in San Francisco are receiving greater attention as elder evictions mount in our city. In several reported cases, evictions resulted in the untimely deaths of the evicted seniors.  Recently, Ingrid Evans, a San Francisco elder abuse attorney with Evans Law Firm Inc, spoke out on the issue.  We want to share her remarks on the growing problem. Landlord-Tenant Law and Elder Abuse Law

When it comes to elder evictions, two distinct bodies of California law come into play according to Ms. Evans: elder abuse law and tenant-landlord law. Lawyers specializing in tenant law are not generally conversant in elder abuse law and vice versa, she observes.  Ms. Evans urged that cooperation between tenant lawyers and elder abuse lawyers is essential: “together we can provide more protection for elders.”  Elder evictions can be truly dire situations and call for action by civil lawyers and law enforcement and tenant rights agencies. Coordinated efforts are not always that easy to come by, however.  Ms. Evans states: “Sometimes we call the district attorney or police to ask them to bring a criminal case and they say ‘we don’t need to do it, because there is a civil lawyer on it.’” 

Sometimes, it is a matter of priorities. Ms. Evans continued: “Criminal agencies go through crimes like murder or rape, but when it comes to elder abuse, especially if it’s financial abuse or harassment, it seems like it is not that important.  But it is important, people are dying from that.  Somebody called me today, whose mother died right after she was evicted, she was 100 years old. I don’t think it is a coincidence.”  Ms. Evans believes that it would be a great thing if eviction of seniors were defined as elder abuse. “It would be easier for elders to get help.  In elder abuse cases you can get attorney’s fees from the party that committed abuse.   Elders don’t have money to pay a tenant-landlord lawyer, but elder abuse protection would allow them to get a lawyer on contingency.  And make it easier for lawyers to take the case.”
