In one recently unsealed whistleblower case, a manufacturer of spinal devices allegedly paid surgeons kickbacks to prescribe the device defendant manufactured. According to the allegations in the complaint, the prescribed devices were in many instances paid for by the government under Medicaid and Medicare. The government has decided to intervene in the case. According to the government, the kickbacks, allegedly disguised as “consulting” payments, amounted to over $8 million.
