Government Investigations of Nursing Home Abuse in California
In California, anyone with complaints about nursing homes can file a complaint with the Licensing and Certification Division of the California Department of Public Health (DPH). Nursing home residents and their loved ones can file complaints of abuse, neglect, or any other matter protected by law including violations of patient rights, poor care, lack of staffing, overmedication, unsafe conditions, mistreatment, physical or sexual assault, improper charges, transfer concerns, and failure to re-admit a resident after a hospital stay. While complaints to DPH are important, you should also reach out to counsel to pursue all remedies for these wrongs. DPH investigations may result in fines but will not result in personal recovery for injury.
The San Francisco and California nursing home abuse attorneys at Evans Law Firm, Inc. represent nursing home residents who are abandoned, neglected, over-medicated or suffering from other abuse. Our attorneys know how to investigate these cases, bring your case to court, and sue for all remedies available to victims. If you or someone you know is suffering from nursing home abuse here in San Francisco or elsewhere in California, call the nursing home abuse attorneys at Evans Law Firm today at 415-441-8669, and we can help.
DPH investigations may aid your court case. Recent changes to California law require DPH to complete investigations of nursing home complaints within 60 days of receipt. You must be notified of the assigned investigator within two working days of your complaint and have the right to accompany the investigator on any visit to the nursing home. Conversely, you have the right to remain anonymous in your complaint. Our attorneys will communicate with DPH investigators regarding their investigation and findings. We will, however, work directly with you on your case whatever those findings and our lawyers will conduct an independent investigation of what happened to you or your loved one and hold the nursing home and staff accountable for any injury.
