Financial Exploitation of Seniors
Stay Alert: It Can Happen to Anyone
Recently, a former California State Assemblywoman shared at an elder abuse symposium that she had been a victim of financial elder abuse.[1] She told her story to raise awareness that financial elder abuse does not discriminate among victims: it can happen to anyone. The San Francisco and California elder abuse attorneys at Evans Law Firm, Inc. know that all too well. Our lawyers fight for elder abuse victims every day in California courts. We know how to pursue those victims’ rights in court. If you or someone you know is the victim of elder abuse in San Francisco or elsewhere in California, help them today by calling the California elder abuse lawyers at Evans Law Firm: 415-441-8669.
In the assemblywoman’s story, a family member/caregiver accumulated massive debt by unauthorized credit card use of the assemblywoman’s elderly, ailing husband. When he died, the debt became hers. It took her a decade to pay it off. Be wary of caregivers and others with access to a senior’s bank accounts, credit cards, and ATM cards. Watch for common signs of financial exploitation:
- Unexpected changes in bank account balances or banking practices.
- Allowing a new friend or caregiver to make decisions on the elderly person’s behalf.
- Unauthorized or unexplained financial account withdrawals.
- Disappearance of funds or valuable possessions.
- Unanticipated transfer of assets to another person or business.
- Sudden changes to a will or other important financial documents.
Recognize the warning signs of abuse and address any suspicions immediately. Alert the police and Adult Protective Services of any suspected abuse and reach out to counsel such as the elder abuse lawyers at Evans Law Firm. Our lawyers will pursue all remedies for victims which include restitution (getting your money back), rescission (undoing wrongful and fraudulent contracts), extra damages (known as punitive damages), and award of attorneys’ fees and costs incurred in bringing wrongdoers to court by a civil complaint.
