A recently reported conclusion of an elder abuse criminal prosecution reveals how sustained financial abuse can be.[1] In that case, federal and local authorities charged two individuals with elder abuse and wire fraud arising from two years of financial exploitation in which defendants allegedly took $1.6 million from an elderly couple. Authorities catalogued over 5000 calls made by the defendants to the elderly couple over a two-year period asking the couple for money for investments that did not exist. The charges claim the defendants spent the money received from their elder victims on restaurants, cigars, luxury retail purchases and repeated travel to Las Vegas and resorts in Hawaii, California, and Oregon. Following a grand jury indictment, defendants plead guilty to certain of the charges and were sentenced to several years in federal prison and ordered to pay restitution.
According to the police, the defendants in the reported case began their financial exploitation of the older couple by ingratiating themselves to them and gaining their trust as new “friends” and persons who could help the seniors invest their money more lucratively. Those facts follow a pattern familiar to our elder abuse litigators.
