San Francisco and California Annuity and Financial Elder Abuse Attorneys: Equity Indexed Annuities

ATTORNEY NEWSLETTER

Beware Equity Indexed Annuities

Modest Yields, Fees, and Withdrawal Charges

Annuity carriers and agents push what they claim are “safer” investment products in volatile markets. Anxious seniors, with money to invest and concerns about future income, worry about low rates on insured deposits on the one hand and the ups and downs of the stock market on the other.  Insurance agents seize on that anxiety and promise a safe bet with indexed annuities.  Don’t buy it.  Indexed annuities are particularly complex, risky, and expensive.  In fact, our lawyers recommend avoiding deferred annuities of any kind, including fixed or equity indexed annuities, especially for seniors.[1]  At a minimum, take a close look before you buy. If you’re over 60 and already purchased a contract here in California and have suffered a loss due to cancellation, replacement, full or partial surrender or high fees, call the California financial elder abuse and annuity attorneys at Evans Law Firm, Inc. today at 415-441-8669 for a free review of your policy.  A list of major carriers in California appears below.

Carriers and agents sell equity indexed annuities as a chance to grow part of your money tied to a stock market index while a portion of your premium is supposedly “guaranteed” a certain return. The problem is that your upside is subject to participation rates (meaning you’re never 100% in any index) and capped so you’ll never achieve a full index return such as you might receive from a direct index fund investment. But what about the promised downside protection?  In reality, that promise is flimsy too.  Upfront sales commissions and annual fees decrease any promised return and your money is tied up for years and subject to withdrawal penalties if you need your money.

That’s what makes equity indexed annuities, like all deferred annuities, so risky for seniors. Your money will be tied up for a long time, subject to hidden fees and expense increases. Any early withdrawal will be subject to charges and forfeiture of any “extra” return in your account.  Withdrawals will also be subject to tax at ordinary rates.  Even if you hold out to the end and refrain from early withdrawals, commissions and other fees erode your return. Bottom line is, beware. Indexed annuities are extremely complicated, and this is just a brief overview.  Always consult a qualified professional who does not stand to gain from any purchase and your tax advisor before making any purchase, replacement or surrender.
