EquiTrust Life Insurance Company
EquiTrust Life Insurance Company, since 2011 a subsidiary of Guggenheim Partners LLC, has long been a major provider of life insurance and annuities products to senior citizens.
A 2008 California class action lawsuit was filed against EquiTrust Life Insurance Co., alleging that the company breached its covenant of good faith and fair dealing. Two counts were certified as a class action by the court. The claimants also sought damages against EquiTrust Life Insurance for its sale of indexed annuities which the plaintiffs claimed were “unlawful, deceptive, unfair” under the CA consumer protection laws but this latter claim was denied certification by the court in 2011. Another case was filed in federal district court in Arizona against EquiTrust Life Insurance Company and the court denied the plaintiff’s initial attempt at class certification, and the case is currently pending on appeal.
