In one recently unsealed whistleblower case (not a case in our firm), the complaint alleges that a manufacturer of spine devices paid surgeons kickbacks to use their devices in operations paid for by the government under Medicaid and Medicare and other government-sponsored health plans. The government has decided to intervene in the case. According to the government, the kickbacks, disguised as “consulting” payments, amounted to over $8 million.
