A CVS subsidiary group – RxAmerica – will pay a $5.25 million settlement in response to false claims allegations against Medicare. Two related complaints were brought on behalf of the U.S. government by whistleblowers under the False Claims Act. These allegations of Medicare fraud involve the Medicare Part D drug plan. Allegations include that RxAmerica misrepresented the cost of its generic drugs to Medicare and Medicaid, allegedly charging much higher prices for its drugs than what was indicated. As a result, RxAmerica was allegedly overpaid by Medicare and Medicaid, while the Medicare program and its participants suffered.
In these and similar cases, whistleblowers are eligible for up to 25% of the money recovered, depending on eligibility and other circumstances.
