The case, filed in 2009, was brought by two doctors/whistleblowers who alleged that defendant offered kickbacks to doctors for prescriptions of one of the pharmaceutical’s leading medications. The kickbacks artificially inflated demand for the drug and thus illegally increased claims for reimbursement under Medicare and Medicaid.
