Class Action Against Security Benefit Life Insurance Company
Policies Marketed as Total Value Annuities
Consumers in a national class-action lawsuit against Security Benefit Life Insurance Co. for misrepresentations made by Security Benefit in connection with the sale of certain fixed indexed annuities scored a victory last year when the Tenth Circuit Court of Appeals reversed the lower court’s dismissal of the complaint. Ella Clinton, et al. v. Security Benefit Life Insurance Company, Case No. 21-3035 (10th Cir., Mar. 28, 2023). The Appellate Court ruled that plaintiffs had sufficiently plead fraud claims against Security Benefit so that the case could move forward to trial. The annuities at issue are marketed as Total Value Annuities and are marketed throughout the country.
The suit alleges that Security Benefit misrepresented returns under certain fixed indexed annuities offering returns based on indices such as the Morgan Stanley Dynamic Allocation Index and the Annuity Linked Trader Vic Index (ALTVI).
