Fair Housing Act Prohibits Discrimination On Basis Of Race, Color, Religion, Sex Or National Origin

Part of the long history of racism in this country includes discrimination in housing, including the availability of mortgage financing. The federal Fair Housing Act (FHA), 42 U.S.C. § 3601-19 prohibits discrimination in home financing based on race, color, religion, sex or national origin. The California Fair Employment and Housing Act (FEHA), Cal. Gov’t Code §§ 12900-12996, protects even more categories of persons from discrimination in home financing: lenders may not discriminate in California on the basis of race, religious creed, color, national origin, ancestry, physical disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, or military or veteran status.
