Government Announces $41.6 Million Settlement In Healthcare Kickbacks Case

Whistleblowers Rewarded $10 Million

The U.S. Department of Justice (DOJ) announced in a recent press release that a large diagnostic laboratory has agreed to pay the U.S. $41.6 million in settlement fees, in addition to an exclusion period preventing the lab from participating in any federal health care programs for twenty-five years. According to the government investigation, defendant was allegedly bribing physicians to refer their patients to defendant’s laboratories for tests eligible for federal reimbursement, and would then allegedly use that money to bribe more physicians, which violates the Anti-Kickback Statute of the False Claims Act (FCA). Six different lawsuits[1]were brought by whistleblowers with these allegations, and with them all now resolved, the whistleblowers will be entitled to 25-30% of the settlement, which could be upwards of $10 million.
