According to the watchdog and support nonprofit California Advocates for Nursing Home Reform (CANHR), increasingly California nursing homes are dumping Med-Cal residents in hospitals and refusing readmission.  According to a complaint filed against one nursing home chain, nursing homes do this in an effort to increase revenues and make space for more lucrative Medicare and private pay patients.  Under federal law, states must provide a “fair hearing” for nursing home residents who claim that they have been illegally evicted.  In the reported case, the nursing home resident prevailed at such a hearing and the California Department of Health Care Services (DHCS) ordered her readmission.  The nursing home refused and suit was brought.

Public interest groups such as CANHR, AARP and the California Long Term Care Ombudsman Association (CLTCOA) are joining in the fight against illegal nursing home evictions.
